Google Inc., Facebook Inc. and other American technology companies were put on the defensive when Edward Snowden's allegations about U.S.-government surveillance of Internet traffic emerged this spring.

Outside the U.S., Some Companies And Politicians Saw An Opportunity.

Three of Germany's largest email providers, including partly state-owned Deutsche Telekom AG, teamed up to offer a new service, Email Made in Germany. The companies promise that by encrypting email through German servers and hewing to the country's strict privacy laws, U.S. authorities won't easily be able to pry inside. More than a hundred thousand Germans have flocked to the service since it was rolled out in August.

"We can say that we protect the email inbox according to German law," says Jorg Fries-Lammers, a spokesman for one of the German companies, 1and1 Internet AG. "It's definitely a unique selling point."




The U.S. National Security Agency has acknowledged collecting email data about Americans through phone and Internet companies. Silicon Valley companies have said that they don't give the government unfettered access to user data but that they are barred from disclosing details.

Fueled by the controversy, countries are seeking to use data-privacy laws as a competitive advantage—a way to boost domestic companies that long have sought an edge over Google, Microsoft Corp. and other U.S. tech giants.

"Countries are competing to be the Cayman Islands of data privacy," says Daniel Castro, a senior analyst at the Information Technology and Innovation Foundation, a nonpartisan Washington, D.C., think tank that receives funding from the tech industry.

While establishing these islands of privacy might make for good marketing, the initiatives face hurdles. Laws demanding that data be stored in-country can give domestic Internet-service providers a boost but also could raise their customers' costs.

"It basically ignores the entire Internet," says Ronaldo Lemos, director of the Institute for Technology and Society, a Rio de Janeiro think tank. "This data has to circulate. It's going to be sent to Miami, to Europe. It's not going to be sitting idle."






Nevertheless, some European leaders are renewing calls for a "euro cloud," in which consumer data could be shared within Europe but not outside the region. Brazil is fast-tracking a vote on a once-dormant bill that could require that data about Brazilians be stored on servers in the country. And India plans to ban government employees from using email services from Google and Yahoo Inc


U.S. Companies Are Watching Such Developments With Trepidation.

"We should all be nervous when countries impose costly new requirements on companies as a condition of serving their citizens," says Facebook Chief Operating Officer Sheryl Sandberg. "It means fragmenting the Internet and putting the economic and social opportunities it creates at risk."

It is too soon to tell if a major shift is under way. But the Information Technology and Innovation Foundation estimates that fallout from revelations about NSA activities could cost Silicon Valley up to $35 billion in annual revenue, much of it from lost overseas business. A survey conducted this summer by the Cloud Security Alliance, an industry group, found that 56% of non-U.S. members said security concerns made it less likely that they would use U.S.-based cloud services. Ten percent said they had canceled a contract.

"We talk to our sales leaders, who talk to customers every day, and this has the potential to significantly erode the trust of customers around the world," says John Frank, a deputy general counsel at Microsoft.

It could be tough for U.S. companies to undo any damage, particularly when the extent of NSA activities is secret and other nations have been critical of the U.S. On Tuesday, Brazilian President Dilma Rousseff in a United Nations address assailed U.S. snooping on her country. Last week she canceled a planned visit to Washington.

European Commission Vice President Neelie Kroes, who supervises the European Union's digital portfolio, has been encouraging the bloc's companies to tout their privacy creds. "Privacy is not only a fundamental right," she said in Estonia this summer. "It can also be a competitive advantage."

For small German companies competing against big ones—like online-security company Symantec Corp. and Amazon.com Inc., which provides corporate cloud services—the NSA surveillance program "is a present from heaven," says Oliver Dehning, chief executive of Antispam-europeGmbH, which builds spam-protection software. "It's kind of an opportunity to strike back and protect our home market."

He turned the Snowden leaks into a marketing campaign, tweeting about the news and speaking at industry conferences about how Germans can protect themselves from spying.

Some of the promises of the would-be data islands could be tough to meet.






While much of the legislation proposes that information about citizens be located in-country, that overlooks that the data may need to be transferred elsewhere.

And laws requiring domestic hosting could raise the price of computing. The in-country hosts could have trouble competing with the economies of scale enjoyed by big U.S. companies, says Jim Reavis, president of the Cloud Security Alliance. Also, it could well be less expensive to use a data center in another country than to build one at home.

Country-specific computing can have its own privacy concerns, meanwhile. Some countries pushing domestic hosting—Brazil, for example—don't protect the privacy of citizens' Internet data, so consumers wouldn't be safe from their own governments' eyes. Brazil made 715 requests for Facebook user data in the first half, according to the company.

Because Germany has strict privacy laws, Email Made in Germany says customers who send email to fellow subscribers can be assured the U.S. and German governments will have a difficult time accessing the users' messages. Customers see a bright-green check mark next to messages sent by fellow subscribers. A gray check appears next to messages from other email providers. That means Germans can ensure their privacy only for email to people on German soil.

Even some companies that seek to profit from fears about U.S. snooping acknowledge that law-enforcement agencies in other countries want to catch up with Washington's capabilities.

"In the long run, there won't be any difference between what the U.S. or Germany or France or the U.K. is doing," says Roberto Valerio, whose German cloud-storage company, CloudSafe GmbH, reports a 25% rise in business since the NSA revelations.

"At the end of the day, some agency will spy on you," he says.

He runs the biggest U.S. bank, Forbes ranks him as one of the 40 most-powerful people in America and he earns more than $25 million a year.

But JPMorgan Chase & Co CEO Jamie Dimon still has to show ID at a government building, just like everyone else.






Dimon met with Attorney General Eric Holder Thursday, amid talk the bank could be near an $11 billion settlement of civil and criminal probes.








The potential cost of a J.P. Morgan Chase JPM +0.73% & Co. settlement with regulators has shot up to $11 billion after U.S. Attorney General Eric Holder rejected the bank's offer of a $3 billion payment to end criminal and civil charges, according to people familiar with the matter.

The possible price tag rose as talks have widened to cover more cases with more regulators.

Discussions between J.P. Morgan, the Justice Department and other agencies were proceeding on Wednesday, although it wasn't clear if all sides would reach an agreement. The talks are still very fluid and could end quickly without a deal being struck, two people familiar with the discussions said.






J.P. Morgan Chase is in discussions to settle probes related to mortgage-backed securities for $11 billion. WSJ's Devlin Barrett says the amount being discussed would include $7 billion cash and $4 billion in relief to consumers.

As large as the potential settlement may be, two people cautioned that even if a deal is reached, it may not resolve one of the biggest dangers for the bank: the potential for criminal charges stemming from the mortgage-backed securities probe. The possibility of such charges is a key incentive for the bank to try to cut a deal, but also one of the most difficult issues on which to reach an agreement, according to the two people familiar with the discussions.


One scenario under discussion would include a $7 billion cash penalty plus $4 billion in relief that J.P. Morgan would provide to consumers, one of these people said.

But the two sides still were billions of dollars apart, depending on which set of investigations might ultimately be resolved in any potential deal, another person said. The price tag could change substantially again if one or more agencies bow out of the discussions.

J.P. Morgan wants any potential pact to make it clear that the probes are finished and that there won't be any further liability on mortgage-backed securities, according to one person familiar with the talks.


Some government lawyers involved in the discussions are trying to firm up the framework of an agreement by next week, one person said.

The talks revolve around residential mortgage-backed securities that J.P. Morgan, Bear Stearns Cos. and Washington Mutual Inc. issued between 2005 and 2007.

Authorities have been investigating whether J.P. Morgan, which acquired Bear Stearns and Washington Mutual during the financial crisis, misled investors about the quality of the underlying mortgages that were tied to the securities. Many of those securities collapsed in value as housing prices eroded. J.P. Morgan has estimated that roughly 70% of the securities involved were issued by the other two institutions.

The mortgage-securities matter is one of J.P. Morgan's largest legal challenges.

The bank last week agreed to pay $920 million and admitted wrongdoing to settle claims with four regulators tied to the London "whale" trading blunder that cost the bank more than $6 billion in 2012. The bank also agreed to pay $80 million to settle claims related to its credit-card practices.

An $11 billion payment would be the largest single-company settlement the Justice Department has ever reached. Last year, the department and nearly all the states' attorneys general announced a $25 billion deal with the five largest mortgage servicers over alleged abuses in that industry.


The Justice Department is leading the mortgage-securities negotiations, which also include the Federal Housing Finance Agency and New York Attorney General Eric Schneiderman.

The FHFA has asked J.P. Morgan to pay more than $6 billion to settle claims the bank misled mortgage-finance companies Fannie Mae and Freddie Mac about the quality of mortgages it sold to them during the housing boom.

Mr. Schneiderman, meanwhile, sued the bank in 2012 over securities issued by Bear Stearns that J.P. Morgan bought in the early days of the financial crisis as Bear Stearns neared collapse. Mr. Schneiderman said that investors lost $22.5 billion on the securities issued by Bear Stearns. At the time Mr. Schneiderman filed the suit, J.P. Morgan said it would contest it and that it was disappointed the New York attorney general "decided to pursue its civil action without ever offering us an opportunity to rebut the claims."

The Justice Department informed J.P. Morgan on Monday that it would file a lawsuit after discussions broke down. J.P. Morgan then offered to pay $3 billion to settle the case, according to a person familiar with the discussions.

Mr. Holder rejected that offer, but the two sides continued to talk, and the possible dollar amount of a deal continued to rise, as the bank sought to resolve other active investigations, according to the person.

If the two sides can't reach an agreement, the government still could file its threatened lawsuit on the mortgage-backed securities case and proceed to court, according to people familiar with the case.



In addition to fines associated with a potential settlement, the Justice Department also could try to wring an admission of wrongdoing from J.P. Morgan. It isn't clear what else the department might seek from J.P. Morgan to eliminate the potential of criminal charges.

Mortgage securities have been a continuing problem for J.P. Morgan as it tries to move past its legal and regulatory woes. The bank already settled a mortgage-backed securities civil case with the U.S. Securities and Exchange Commission late last year. In that case, the bank agreed to pay $296.5 million. The bank didn't admit or deny allegations of misconduct.

Another settlement on mortgage securities wouldn't necessarily close the door on J.P. Morgan's troubles, however. The U.S. Attorney for the Southern District of New York is investigating people involved with the London whale blunder. And the Commodity Futures Trading Commission is looking into whether the bank manipulated a market index tied to corporate bonds, according to people familiar with the situation.

J.P. Morgan Chief Executive James Dimon and the bank's board of directors are eager to move past their regulatory quagmire and increasingly are willing to pay to settle cases, according to people familiar with the bank's strategy. Executives and board members are concerned the lingering fallout will weigh on employee morale and could ultimately hurt the bank's performance.

BTC China Soon To Become The
World’s Largest Bitcoin Exchange








BTC China has become the world’s first major bitcoin exchange to scrap its trading commission fees, albeit temporarily.

The company, which launched in June 2011, was charging 0.3% for all trades made on the site before taking the decision to run a promotion eliminating this fee.

“We already deliver an outstanding consumer experience, and with this promotion, we will now also offer superb value. The future is bright, for bitcoin in China,” said Bobby Lee, CEO of BTC China.

He explained the promotion will continue to run over the Chinese National Day holiday, but could not confirm its end date.

The halting of trading commission fees follows the company’s decision to scrap deposit fees in July, which Lee said was to encourage further bitcoin adoption in China.

“We think China can become a healthy market for bitcoin, so we want to take this opportunity to cement our position as the top exchange in China, and one of the top globally,” he added.

The Rise of BTC China

BTC China was the country’s first bitcoin exchange and Lee says he has seen many competitors come and go over the past two years. He puts his own company’s success down to its long-term focus.

“From the beginning, we have put emphasis on security, high performance, and ease-of-use,” he explained, adding:

“In China, we remain the leading exchange because of the market depth and huge liquidity in our market.

This all stems from our large customer base, the biggest in China. We have their trust, and we provide them with great customer service.”  

Lee said that, regardless of the fact the site only allows users to buy and sell in the native Chinese currency, it has been climbing the worldwide bitcoin exchange rankings. Currently, BTC China is ranked at number three in terms of the highest volume of bitcoin transactions processed, overtaking BTC-e.

Bitcoin Regulation In China

Compared to other governments, China has been very quiet on the subject of bitcoin, but Lee believes this isn’t necessarily a bad thing.

“The Chinese government has much bigger responsibilities and many more important things to attend to. As with all new technologies and developments in China, I think the government is taking a prudent approach; they are waiting a bit, and watching to see how it develops,” he added.







Lee believes it is only a matter of time before bitcoin is regulated not only in China, but across the world and said his company is looking forward to working with the Chinese government to devise local regulation.

Bitcoin Popularity

Lee thinks bitcoin has the opportunity to really take off in China and said the country already has a “healthy appetite” for it. “With a strong history and culture in savings, the Chinese people intuitively understand the fundamental properties of a limited-supply digital asset.”

He added:

For the first time in human history, bitcoin has allowed people to save and defer purchasing power, in a digital form. The Chinese people love this concept! It explains bitcoin’s fast adoption in China this year – 2013 has been a breakout year for bitcoin, and even more so in China.”

So far this year, according to data on SourceForge, China is only second to the US in terms of the volume of downloads of the original bitcoin client (Bitcoin-Qt). Some 248,105 downloads of Bitcoin-Qt have taken place in China, compared with 485,186 in the US and 103,548 in the UK.

Lee said bitcoins are being used differently in China than they are in the West. In his opinion, the western world seems to be putting a focus on bitcoin as a payment system, so merchant acceptance is used as a key metric for how bitcoin is succeeding.

In China, however, the digital currency’s popularity is somewhat harder to measure as bitcoin is seen as more of an asset class and an investment vehicle that allows people to protect their money from inflation.

“That partially explains why trading of bitcoin has gone up in China over the past six months. We expect to see volumes pick up over the coming months and I wouldn’t be surprised if one day bitcoin trading volume in [Chinese currency] RMB overtakes the volume traded in US dollars,” Lee said.

He even thinks this could happen within the next year or so, resulting in the price per bitcoin being listed primarily in RMB on bitcoin charting and price sites (and perhaps even CoinDesk’s own BPI).
